Terms
Revision: 19 September 2026
Terms of use of the site and of the services
1. What this document is
1.1. These Terms govern the use of the website forwardvisa.com (the “Site”) and describe the general conditions on which services are provided under the Forward Visa brand.
1.2. Services are provided by advocate Sergei Voronin, address: Kholodilny per. 3, bldg. 1, str. 4, Moscow (the “Provider”, “we”). Forward Visa is an agency for immigration to the United States; legal assistance under that brand is provided by an advocate under a legal-services agreement (Art. 25 of Federal Law No. 63-FZ of 31 May 2002).
1.3. By using the Site or submitting forms on it, you confirm that you have read these Terms and the Privacy Policy.
1.4. The payment, refund-guarantee and complimentary-translation terms in sections 5–7 are incorporated into the client agreement in the version that was in force on the date it was signed.
2. Information on the Site
2.1. Materials on the Site — descriptions of visa categories, criteria, timelines and rule changes — are informational and are not legal advice on your situation. U.S. immigration rules change; we date materials for currency, but we do not warrant that the information remains accurate after that date.
2.2. An advocate–client relationship arises when an agreement is signed. Sending a form, correspondence and a consultation do not by themselves create that relationship, but information received in a consultation is protected by advocate–client privilege (Art. 8 of No. 63-FZ).
2.3. Fees on the Site are information about the price of typical services. The final fee, scope and timelines are fixed in the agreement.
2.4. The result of the “Check your chances” form is a preliminary automated estimate based on your answers. It is not an advocate’s opinion and does not guarantee an outcome.
3. Services
3.1. Initial consultation — complimentary. Conducted by video or messenger. We review your situation and say whether there is a basis for one of the categories and whether to proceed to an audit.
3.2. Profile audit — $250. A written advocate's opinion: the suitable category, criteria already closed, what is missing and a plan to close it. Prepared within 5 business days of receiving your information and documents. If a legal-representation agreement is signed, the audit fee is credited against its fee.
3.3. Legal representation — $10,000. Includes: help collecting and structuring evidence; preparing recommendation letters; preparing the petition; completing all required forms; support through the case; a complete package ready for filing; answers to your questions and control of the case at every stage; certified translation of the petition package documents (section 7).
3.4. Not included in the representation fee and billed separately: USCIS and consular filing fees; premium processing; notarizations; PR services; a response to a request for evidence (RFE); third-party services. A refiling is billed separately except as provided by the guarantee (section 6).
3.5. PR services are provided under a separate program and billed separately. The program, scope and fee are fixed after the audit.
3.6. The petition is filed with USCIS by the petitioner: you (EB-1A, EB-2 NIW) or your employer or agent (O-1). We prepare the package and support the filing; we do not appear as counsel before U.S. agencies.
4. Client duties
4.1. Provide complete and accurate information and documents on the agreed timelines; notify us of changes that may affect the case: a change of job, status or country of stay, denials and bars to admission.
4.2. Carry out the audit recommendations on closing criteria on the agreed timelines, where they are a condition of filing.
4.3. Pay for services on the schedule in the agreement.
4.4. Not use materials prepared by the Provider to file other petitions without agreement.
4.5. Provide requested information, documents and revisions within 5 business days of the request. Delay shifts the preparation timelines in the agreement by the period of delay; a delay of more than 30 calendar days suspends work on the case until the materials arrive.
4.6. The petition-preparation period under the agreement is up to 6 months from the date it is signed, if the client cooperates on time. An extension for reasons depending on the client is documented in a supplemental agreement; the terms of extension are fixed in the agreement.
5. Payment and installments
5.1. Payment is made against an invoice by the method and in the currency stated in the agreement. Wire transfer and payment in digital assets (USDT, BTC) are accepted. For payment in rubles the amount is determined at the Bank of Russia rate on the day of payment, unless the agreement provides otherwise.
5.2. The client pays for representation in full or in installments — up to 6 months in equal monthly payments with no markup. The payment schedule is in the agreement.
5.3. The finished document package is delivered to the client after the representation fee has been paid in full.
5.4. If a payment is more than 10 calendar days late, work on the case is suspended until payment arrives; the agreement timelines shift by the period of suspension.
5.5. The profile-audit fee is credited against the legal-representation fee.
6. Refund guarantee
6.1. If USCIS issues a final denial of a petition prepared by the Provider, the Provider prepares a refiling with an updated evidence record without a professional fee. There are up to three refilings under the guarantee, that is up to four filings in total under one agreement.
6.2. If a final denial is also issued on the fourth filing, the client is refunded the legal-representation fee paid under the agreement, including the credited audit fee.
6.3. A final denial is a USCIS decision denying the petition (I-140 or I-129) after all responses to USCIS requests have been considered. The following are not a denial: a request for evidence (RFE), a notice of intent to deny (NOID) before a decision, an administrative closure, or withdrawal of the petition by the client or petitioner.
6.4. The guarantee applies if, for each filing, the client provided complete and accurate information and documents on the agreed timelines; carried out the audit recommendations and the recommendations after a denial that were a condition of filing; provided materials for an RFE response on the agreed timelines and paid for the RFE-response service if a request arrived; did not change the facts on which the petition was built, including a change of field; and the refiling was started on the agreed schedule no later than 6 months from the date of denial. For O-1 a refiling is possible if the petitioner is willing.
6.5. The guarantee does not apply if the denial is based on inaccurate information provided by the client or by third parties at the client’s direction; on withdrawal of the petition; on a payment-default that caused work to be suspended; or if the petition was filed in a form altered by the client without the Provider’s agreement. A client’s refusal of a refiling offered under the guarantee ends the guarantee and does not give rise to a fee refund.
6.6. The guarantee covers only the decision on the petition. It does not cover decisions on an immigrant visa at a consulate, on an application to adjust status (I-485), refusals of admission, or inadmissibility grounds unrelated to the content of the petition.
6.7. The following are not refunded and are not covered by the guarantee: government filing fees on each filing, the cost of premium processing, PR services, notarizations, RFE responses and third-party services. Filing fees on refilings are paid by the client.
6.8. A refund is made within 30 calendar days of the Provider receiving a copy of the USCIS decision on the fourth filing, by the same method and in the same currency or digital asset in which payment was made, unless otherwise agreed.
7. Certified translation
7.1. Certified translation of documents in the petition package prepared by the Provider is included in the representation fee. Translation is into English and is accompanied by a translator’s certification meeting USCIS requirements.
7.2. Not included and billed separately: translations for later stages (adjustment of status, consular processing), translations of documents for an RFE response, notarization of translations, and translations of documents that were not part of the petition package.
8. Confidentiality and intellectual property
8.1. Information received in connection with legal assistance constitutes advocate–client privilege and is not disclosed.
8.2. Materials on the Site — text, structure, design, images — belong to the Provider. Copying and use without written permission is not allowed, except quotation with a credit to the Site.
8.3. Documents and information provided by the client remain the client’s property. The petition, letters and other materials prepared for the client are delivered to the client for use in the client’s case.
8.4. Information about a case is published on the Site only with the client’s written consent and in the volume agreed with the client.
9. Liability
9.1. Decisions on petitions, visas and status are made by U.S. government agencies. The Provider does not guarantee approval and is not liable for those decisions, the time they take, or changes in law and practice, except for the obligations under the guarantee (section 6).
9.2. The Provider’s liability under the agreement is limited to the fee paid under it, unless the law provides otherwise.
9.3. The Provider is not liable for the acts of third parties, including the petitioner, an employer, postal and courier services, for the inaccuracy of information provided by the client, or for the consequences of providing it to government agencies.
10. Communications
10.1. We communicate with clients by email, Telegram, WhatsApp, Max and video. We reply within one business day, Moscow time.
