Policy on the processing of personal data
1. Who we are and what this document covers
1.1. The personal data operator is advocate Sergei Voronin, address: 3, bldg. 1, str. 4, Kholodilny Lane, Moscow (hereinafter “we”, the “Operator”). Email for personal-data questions: info@forwardvisa.com.
1.2. This Policy describes what data we receive through the website forwardvisa.com (the “Site”), forms on it, email and messengers, why we process them, to whom we transfer them, and what rights you have.
1.3. We process personal data in accordance with Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”, Federal Law No. 63-FZ of 31 May 2002 “On Advocacy and the Bar in the Russian Federation”, and, for visitors from the European Union and the EEA, also the General Data Protection Regulation (GDPR).
1.4. By submitting any form on the Site, you confirm that you have read this Policy and consent to the processing of the data provided in the form for the purposes described in section 3.
2. What data we process
2.1. Data from Site forms: name; email address; phone number or messenger username (Telegram, WhatsApp, Max); answers in the “Check your chances” form: field of work, country of residence and U.S. status, experience, professional achievements, goal and intended timeline; convenient time for a call; comment text.
2.2. Data for concluding and performing an agreement for legal assistance: passport details, date and place of birth, citizenship, address, education, employment, income, publications, awards, memberships, family status and family members, immigration history — to the extent needed to prepare filings for USCIS and other U.S. authorities. We receive this data from you directly after an agreement is signed, not through Site forms.
2.3. Technical data: IP address, browser and device data, pages of the Site you visited, referral source and UTM tags, cookies and analytics identifiers.
2.4. Correspondence data: the content of messages in email and messengers if you contact us that way.
2.5. Through the Site we do not request biometric data or special categories of personal data (racial or ethnic origin, political or religious views, health, intimate life). If such information is needed for a specific petition, we will request it separately and with a separate written consent.
3. Why we process data
3.1. To respond to your request, hold an initial consultation and make a preliminary assessment of a visa category.
3.2. To conclude and perform an agreement for legal assistance: audit the profile, build the evidence record, recommendation letters, the petition and forms.
3.3. To send information about changes in U.S. immigration rules — only if you subscribed to the mailing list. You may unsubscribe at any time.
3.4. To operate the Site, analyse traffic and advertising performance, and protect the Site from abuse.
3.5. To comply with legal requirements, including maintaining an advocate file and retaining documents.
We do not sell personal data and do not transfer it to third parties for their own advertising.
4. Legal bases
4.1. Your consent — for processing data from Site forms, cookies and the mailing list (Art. 6(1)(1) of 152-FZ; Art. 6(1)(a) GDPR).
4.2. Conclusion and performance of an agreement for legal assistance (Art. 25 of 63-FZ; Art. 6(1)(5) of 152-FZ; Art. 6(1)(b) GDPR).
4.3. Performance of duties imposed on an advocate by law (Art. 6(1)(2) of 152-FZ).
4.4. Our legitimate interest in operating and securing the Site (Art. 6(1)(f) GDPR) — for technical data of visitors from the EU/EEA.
6. Who we share data with
6.1. To operate the Site and process requests we use services that receive data only to the extent needed for their functions:
- Vercel Inc. (USA) — Site hosting and form processing;
- Cloudflare, Inc. (USA) — DNS and attack protection;
- Resend, Inc. (USA) — delivery of lead notifications to our email;
- Neon, Inc. (USA) — leads database;
- the corporate email provider for info@forwardvisa.com;
- Yandex LLC (Russia) and Google LLC (USA) — web analytics when the Site is opened;
- Vimeo.com, Inc. (USA) — video hosting; the player loads only after the play button is pressed, with the dnt=1 parameter (no tracking);
- messenger operators Telegram, WhatsApp (Meta Platforms, Inc.) and Max (VK LLC) — if you write to us in a messenger; their processing of your data is governed by their own policies.
6.2. When performing an agreement for legal assistance, data may be transferred, with your consent, to licensed U.S. attorneys, translators, notaries and media — only to the extent needed to prepare and file documents or a publication you know about.
6.3. We may disclose data upon a lawful request of a competent public authority or a court.
7. Cross-border transfer
7.1. Servers of some of the services in section 6 are located outside the Russian Federation, including in the United States. By submitting a form on the Site, you consent to the cross-border transfer of data to these services.
7.2. The Operator has filed a notice with Roskomnadzor of the intention to carry out cross-border transfer of personal data under Art. 12 of 152-FZ [filing date].
7.3. For visitors from the EU/EEA, transfers to the United States are made on the basis of the European Commission’s Standard Contractual Clauses or the recipient’s certification under the EU–U.S. Data Privacy Framework.
8. How long we keep data
8.1. Lead data where no agreement is signed — 12 months from the last contact, then deleted or anonymised.
8.2. Data under an agreement for legal assistance — for the term of the agreement and at least three years after it ends, unless a longer period is required by law or to protect your interests (for example, responding to a USCIS request).
8.3. Mailing-list data — until you unsubscribe.
8.4. Technical and analytics data — within the periods set by the relevant services, but no more than 24 months.
9. Your rights
9.1. You may: obtain information about which of your data we process; request that it be corrected, blocked or deleted; withdraw consent; unsubscribe from the mailing list; object to processing based on legitimate interest; for visitors from the EU/EEA — receive the data in a machine-readable format and lodge a complaint with the supervisory authority of your country.
9.2. Send a request to info@forwardvisa.com from the email address or messenger specified in the lead. We reply within 10 business days (Art. 20 of 152-FZ); for GDPR requests — within 30 days.
9.3. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal and does not stop processing that we are required to continue by law or to perform an agreement.
9.4. A complaint about the Operator’s actions may be filed with the Federal Service for Supervision of Communications, Information Technology and Mass Media (Roskomnadzor).
10. How we protect data
10.1. The Site runs over HTTPS; form data is transmitted encrypted; access to leads and the database is limited to the Operator and persons authorised by the Operator; access to services is protected by two-factor authentication.
10.2. Information related to an advocate’s legal assistance constitutes advocate–client privilege (Art. 8 of 63-FZ) and is not to be disclosed, regardless of this Policy.
10.3. We cannot guarantee absolute security of data transmitted over the internet, but we take reasonable organisational and technical measures appropriate to the nature of the data processed.
11. Children
The Site is intended for persons over 18. We process data of a principal’s minor family members only under an agreement for legal assistance and on the basis of consent of their parents or legal guardians.
12. Changes to the Policy
We may update the Policy. The current version is always published at forwardvisa.com/en/privacy with the date. For material changes we will post a notice on the Site and email mailing-list subscribers.
